Terms of Service

Important Notice
Plan365Trip maintains a ZERO-TOLERANCE POLICY for harassment, abuse, hate speech, and any form of harmful behavior. Violations will result in immediate account suspension or permanent ban without prior warning.
1. Acceptance of Terms
Welcome to Plan365Trip, a product of VCXOS Management and Technologies LLP. By accessing or using our website, mobile application, or any of our services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Community Guidelines. If you do not agree to these Terms in their entirety, you must not use the Service.
We reserve the right to modify these Terms at any time. Material changes will be notified via email to registered users at least 15 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance. If you disagree with changes, you must stop using the Service and delete your account.
2. Description of Service
Plan365Trip is a group travel coordination platform that helps working professionals plan trips together by:
- Visualizing group availability and overlapping holidays
- Calculating bridge leave opportunities to maximize trip duration
- Facilitating group communication and trip planning
- Suggesting seasonal destinations based on group preferences
The Service is provided for personal, non-commercial use only. Commercial use, including travel agency activities, requires written authorization.
3. Eligibility
You must be at least 16 years old to use Plan365Trip. By creating an account, you represent and warrant that:
- You are at least 16 years of age
- You have the legal capacity to enter into binding agreements
- You will provide accurate, truthful, and complete information
- You will maintain the security and confidentiality of your credentials
- You have not been previously banned from the Service
- You are not creating an account on behalf of someone who has been banned
Users aged 16-18 confirm they have parental/guardian consent to use the Service.
4. Account Registration & Security
4.1 Account Creation
To use the Service, you must create an account with a valid email address. One person may maintain only ONE account. Creating multiple accounts ("sockpuppets") to evade bans, manipulate features, or deceive other users is strictly prohibited and will result in permanent ban of all associated accounts.
4.2 Username Policy
Your username is permanent and cannot be changed. Usernames must not:
- Impersonate real individuals, brands, or organizations
- Contain offensive, discriminatory, or harmful language
- Include profanity, slurs, or hate speech (including disguised versions)
- Promote violence, illegal activities, or self-harm
- Violate intellectual property rights
We reserve the right to force-change or disable usernames that violate this policy.
4.3 Account Security
You are solely responsible for all activities under your account. You must:
- Use a strong, unique password
- Never share your credentials with anyone
- Immediately report unauthorized access via our security email
- Log out on shared or public devices
We are not liable for losses from unauthorized account access due to your negligence.
5. Zero-Tolerance Anti-Harassment Policy
Plan365Trip is committed to providing a safe, respectful environment for all users. We have ZERO TOLERANCE for harassment and harmful behavior.
5.1 Absolutely Prohibited Conduct
The following behaviors are strictly prohibited and will result in immediate action:
Harassment & Abuse
- Direct or indirect threats of violence, harm, or intimidation
- Stalking, following, or unwanted persistent contact
- Doxxing (sharing someone's private information without consent)
- Encouraging others to harass or harm someone
- Creating content designed to humiliate or embarrass someone
- Repeated unwanted contact after being asked to stop
Hate Speech & Discrimination
- Attacks based on race, ethnicity, national origin, or caste
- Attacks based on religion, religious practice, or lack thereof
- Attacks based on gender, gender identity, or sexual orientation
- Attacks based on disability, serious illness, or medical condition
- Dehumanizing speech comparing people to animals, insects, or objects
- Promoting or glorifying hate groups or ideologies
- Use of slurs, symbols, or imagery associated with hate
Sexual Harassment & Exploitation
- Unwanted sexual advances or propositions
- Sharing or requesting sexually explicit content
- Sexual comments, jokes, or innuendos about other users
- Non-consensual sharing of intimate images (NCII/revenge porn)
- Sexual exploitation or grooming of minors (immediate permanent ban and law enforcement referral)
Violence & Dangerous Behavior
- Threats of physical violence
- Celebrating or glorifying violent acts
- Promoting terrorism, extremism, or violent organizations
- Content depicting graphic violence
- Encouraging self-harm or suicide
- Instructions for creating weapons or dangerous materials
Fraud & Deception
- Impersonating other users or staff
- Phishing or attempts to steal credentials
- Scams or fraudulent schemes
- Spreading malware or malicious links
- Deliberately spreading misinformation
5.2 General Prohibited Conduct
- Violating any applicable laws or regulations
- Spamming or sending unsolicited bulk messages
- Attempting to gain unauthorized access to systems or accounts
- Interfering with or disrupting the Service
- Using automated tools (bots, scrapers) without authorization
- Circumventing security measures or rate limits
- Collecting user information without consent
- Posting content that infringes intellectual property rights
6. Reporting Violations
6.1 How to Report
If you witness or experience any violation of these Terms, please report immediately:
- In-App: Use the "Report" button on any message or user profile
- Group Admin: Contact your group admin for group-specific issues
- Email: hello@plan365trip.com with subject line "Report: [Issue Type]"
- Urgent Safety Issues: hello@plan365trip.com with "URGENT SAFETY" in subject
6.2 What to Include in Reports
- Username of the person you are reporting
- Description of the violation
- Screenshots or other evidence (if available)
- Date and time of the incident
- Group name (if applicable)
6.3 Our Response Commitment
- Acknowledgment: Within 24 hours
- Initial Review: Within 48 hours
- Resolution: Within 7 days (complex cases may take longer)
- Urgent Safety Issues: Prioritized and addressed within 4 hours
6.4 Reporter Protection
We protect the identity of reporters. Retaliation against anyone who reports a violation in good faith is itself a violation that will result in immediate action. However, filing false reports or abusing the reporting system is also prohibited.
7. Enforcement & Consequences
7.1 Enforcement Actions
Depending on the severity, frequency, and nature of violations, we may take the following actions:
Warning
For minor, first-time violations. You will be notified of the specific rule violated and expected behavior going forward.
Content Removal
Violating content will be removed. Repeated violations may lead to account restrictions.
Feature Restriction
Temporary or permanent restriction from specific features (e.g., chat, creating groups).
Temporary Suspension
Account suspended for 7-30 days. Suspension duration increases with repeat violations.
Permanent Ban
Permanent removal from the platform. Applied for severe violations or repeat offenders. Banned users may not create new accounts.
Legal Referral
For criminal conduct (threats, CSAM, fraud), we will report to law enforcement and cooperate fully with investigations.
7.2 Immediate Ban Offenses
The following will result in immediate permanent ban without warning:
- Any content involving minors inappropriately
- Credible threats of violence
- Doxxing (sharing private information)
- Non-consensual intimate imagery
- Terrorism or extremism promotion
- Creating accounts to evade previous bans
- Targeted harassment campaigns
7.3 Appeals Process
If you believe an enforcement action was taken in error, you may appeal:
- Submit an appeal to hello@plan365trip.com within 14 days
- Include your username, the action taken, and why you believe it was incorrect
- Appeals are reviewed by a different team member than the original decision
- You will receive a response within 14 days
- Appeal decisions are final
8. Groups and Invites
8.1 Group Creation
Users can create groups for trip planning. The creator becomes the group admin with additional privileges and responsibilities, including member approval and content moderation.
8.2 Admin Responsibilities
Group admins are responsible for:
- Reviewing and approving member requests
- Moderating content and enforcing group rules
- Removing members who violate Terms or group rules
- Reporting serious violations to Plan365Trip
Admins who fail to moderate harmful content or who themselves violate Terms may have their admin privileges revoked or face account action.
8.3 Member Approval
All group joins require approval from a group admin. Pending members cannot access group content until approved.
8.4 Invite Links
Invite links may have expiration dates and usage limits. Do not share invite links publicly. If an invite link is abused, it will be revoked.
9. Content
9.1 User Content
You retain ownership of content you create (messages, trip proposals, etc.). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute your content solely for operating the Service.
9.2 Content Moderation
We employ both human moderators and automated systems to detect violations. Group admins can delete messages within their groups. All users can report violations.
9.3 Content Removal
We reserve the right to remove any content that violates these Terms, without prior notice. Removed content may be retained for legal compliance or investigation purposes.
9.4 No Obligation to Monitor
While we may monitor content, we are under no obligation to do so. We are not liable for user-generated content that we have not reviewed.
10. Intellectual Property
The Service and its original content (excluding user content), features, functionality, design, and trademarks are owned by VCXOS Management and Technologies LLP and are protected by copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or distribute our content without permission
- Use our trademarks, logos, or branding without written consent
- Reverse engineer, decompile, or attempt to extract source code
- Create derivative works based on the Service
11. Third-Party Services
The Service may integrate with third-party services (Google OAuth, mapping services, destination content). We are not responsible for third-party content, privacy practices, or availability. Your use of third-party services is governed by their respective terms.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
WE DO NOT WARRANT THAT:
- The Service will be uninterrupted, secure, or error-free
- Bridge leave calculations or availability visualizations are accurate
- Destination recommendations are suitable for your needs
- Other users will behave appropriately
You assume all risk when meeting other users in person. Verify travel plans independently.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PLAN365TRIP, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, goodwill, or business opportunities
- Damages arising from user conduct or content
- Damages from meeting other users in person
- Damages from reliance on Service information
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) INR 5,000.
14. Indemnification
You agree to indemnify, defend, and hold harmless Plan365Trip and its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your content or conduct on the Service
- Any claim that your content caused damage to a third party
15. Account Termination
15.1 By You
You may delete your account at any time through settings or by contacting us. Upon deletion:
- Your personal data will be deleted within 30 days
- Your messages may remain visible but anonymized
- Some data may be retained for legal compliance
- Groups you created will need a new admin or be archived
15.2 By Us
We may suspend or terminate your account for:
- Violation of these Terms
- Violation of our anti-harassment policy
- Illegal activity
- Creating multiple accounts
- Extended inactivity (12+ months)
- At our sole discretion, with or without notice
15.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. Sections regarding liability, indemnification, dispute resolution, and intellectual property survive termination.
16. Dispute Resolution
Important: Please Read Carefully
This section affects your legal rights. By using the Service, you agree to resolve disputes through the process outlined below.
16.1 Informal Resolution First
Before initiating any formal dispute, you must first contact us at hello@plan365trip.com to attempt informal resolution. We will respond within 14 days. Most disputes can be resolved this way.
16.2 Mediation
If informal resolution fails, either party may request mediation before a mutually agreed mediator in Bangalore, India. Mediation costs will be shared equally. The mediation process must be completed within 60 days of the request.
16.3 Arbitration
If mediation fails, disputes shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be:
- Conducted in English
- Held in Bangalore, India
- Decided by a single arbitrator mutually agreed upon
- Governed by Indian law
16.4 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in class actions against Plan365Trip.
16.5 Exceptions
Either party may seek injunctive relief in a court of competent jurisdiction for violations of intellectual property rights or confidentiality obligations.
16.6 Time Limitation
Any dispute must be raised within ONE (1) year from when the cause of action arose, or it is permanently barred.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Subject to the dispute resolution provisions above, any legal proceedings shall be brought exclusively in the courts of Bangalore, Karnataka, India.
18. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
19. Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.
20. Entire Agreement
These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Plan365Trip regarding the Service and supersede all prior agreements, understandings, and communications.
